    About me

    I am Andre, 41 years old and an aspiring self-taught abstract artist.

    I came to my art in 2021 and found my calling in it.

    It all started with my trip through LA and New York where I discovered my passion for photography.

    A little later, I bought my first canvas and some paints, put on my headphones and just started painting.

    To this day, abstract painting fascinates me with its many wonderful facets.

    Switch off, immerse yourself and just do what is going through your head.

    Translating my emotions onto canvas is art.

    You can just do what you like and there are no limits or right or wrong.

    My personal style, modern, crazy and different.

    I don't have a particular style, I just paint whatever is on my mind and that's what makes each work of art so different.

    I mainly paint with acrylic paint and use brushes and my hands.

    My biggest role models are Jackson Pollock, Gerhard Richter and Simon Bull.

    So far I have had the opportunity to exhibit in Stockholm, New York and Germany and have collectors from Germany and Switzerland.

    1) Scope

    1.1 These General Terms and Conditions (hereinafter "GTC") of Andre Bräuer (hereinafter "Seller") apply to all contracts for the delivery of goods that a consumer or entrepreneur (hereinafter "Customer") concludes with the Seller with regard to the goods presented by the Seller in his online shop. The inclusion of the Customer's own conditions is hereby contradicted, unless otherwise agreed.

    1.2 A consumer within the meaning of these General Terms and Conditions is any natural person who concludes a legal transaction for purposes that can predominantly neither be attributed to their commercial nor their independent professional activity.

    1.3 An entrepreneur within the meaning of these General Terms and Conditions is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of his or her commercial or independent professional activity.

    2) Conclusion of contract

    2.1 The product descriptions contained in the seller's online shop do not constitute binding offers on the part of the seller, but serve to submit a binding offer by the customer.

    2.2 The customer can submit the offer using the online order form integrated into the seller's online shop. After placing the selected goods in the virtual shopping cart and completing the electronic ordering process, the customer submits a legally binding contract offer for the goods contained in the shopping cart by clicking the button that completes the ordering process. The customer can also submit the offer to the seller by email or using the online contact form.

    2.3 The Seller may accept the Customer’s offer within five days,

    • by sending the customer a written order confirmation or an order confirmation in text form (fax or e-mail), whereby the receipt of the order confirmation by the customer is decisive, or
    • by delivering the ordered goods to the customer, whereby the receipt of the goods by the customer is decisive, or
    • by requesting payment from the customer after placing his order.

    If several of the aforementioned alternatives exist, the contract is concluded at the time at which one of the aforementioned alternatives occurs first. The period for accepting the offer begins on the day after the offer is sent by the customer and ends on the expiry of the fifth day following the sending of the offer. If the seller does not accept the customer's offer within the aforementioned period, this is deemed to be a rejection of the offer with the consequence that the customer is no longer bound by his declaration of intent.

    2.4 If a payment method offered by PayPal is selected, payment processing will be carried out via the payment service provider PayPal (Europe) S.à rl et Cie, SCA, 22-24 Boulevard Royal, L-2449 Luxembourg (hereinafter: "PayPal"), subject to the PayPal terms of use, which can be viewed at https://www.paypal.com/de/webapps/mpp/ua/useragreement-full or - if the customer does not have a PayPal account - subject to the conditions for payments without a PayPal account, which can be viewed at https://www.paypal.com/de/webapps/mpp/ua/privacywax-full . If the customer pays using a payment method offered by PayPal that can be selected during the online ordering process, the seller hereby declares acceptance of the customer's offer at the time the customer clicks the button that completes the ordering process.

    2.5 When submitting an offer via the seller's online order form, the contract text is saved by the seller after the contract has been concluded and sent to the customer in text form (e.g. email, fax or letter) after the order has been sent. The seller will not make the contract text available beyond this.

    2.6 Before submitting the binding order via the seller's online order form, the customer can identify possible input errors by carefully reading the information displayed on the screen. An effective technical means for better identifying input errors can be the browser's zoom function, which helps to enlarge the display on the screen. The customer can correct his entries as part of the electronic ordering process using the usual keyboard and mouse functions until he clicks the button that completes the ordering process.

    2.7 Only the German language is available for the conclusion of the contract.

    2.8 Order processing and contact are usually carried out via email and automated order processing. The customer must ensure that the email address provided by him for order processing is correct so that emails sent by the seller can be received at this address. In particular, when using SPAM filters, the customer must ensure that all emails sent by the seller or by third parties commissioned by the seller to process the order can be delivered.

    3) Right of withdrawal

    3.1 Consumers generally have a right of withdrawal.

    3.2 Further information on the right of withdrawal can be found in the seller’s cancellation policy.

    4) Prices and payment terms

    4.1 Unless otherwise stated in the seller's product description, the prices quoted are total prices. Sales tax is not shown, as the seller is a small business within the meaning of the VAT Act. Any additional delivery and shipping costs are stated separately in the respective product description.

    4.2 For deliveries to countries outside the European Union, additional costs may be incurred in individual cases for which the seller is not responsible and which must be borne by the customer. These include, for example, costs for the transfer of money by credit institutions (e.g. transfer fees, exchange rate fees) or import duties or taxes (e.g. customs duties). Such costs may also be incurred in relation to the transfer of money if the delivery is not made to a country outside the European Union, but the customer makes the payment from a country outside the European Union.

    4.3 The payment option(s) will be communicated to the customer in the seller’s online shop.

    4.4 If the payment method "SOFORT" is selected, payment processing will be carried out by the payment service provider SOFORT GmbH, Theresienhöhe 12, 80339 Munich (hereinafter "SOFORT"). In order to pay the invoice amount via "SOFORT", the customer must have an online banking account activated for participation in "SOFORT", identify themselves accordingly during the payment process and confirm the payment instruction to "SOFORT". The payment transaction will be carried out immediately afterwards by "SOFORT" and the customer's bank account will be debited.     5) Delivery and shipping conditions

    5.1 If the seller offers to ship the goods, delivery will be made within the delivery area specified by the seller to the delivery address specified by the customer, unless otherwise agreed. When processing the transaction, the delivery address specified in the seller's order processing is decisive.

    5.2 If the delivery of the goods fails for reasons for which the customer is responsible, the customer shall bear the reasonable costs incurred by the seller as a result. This does not apply to the costs of delivery if the customer effectively exercises his right of cancellation. If the customer effectively exercises his right of cancellation, the provisions in the seller's cancellation policy apply to the return costs.

    5.3 If the customer is acting as an entrepreneur, the risk of accidental loss and accidental deterioration of the goods sold passes to the customer as soon as the seller has delivered the item to the freight forwarder, the carrier or the person or institution otherwise designated to carry out the shipment. If the customer is acting as a consumer, the risk of accidental loss and accidental deterioration of the goods sold generally only passes when the goods are handed over to the customer or a person authorized to receive them. In deviation from this, the risk of accidental loss and accidental deterioration of the goods sold also passes to the customer in the case of consumers as soon as the seller has delivered the item to the freight forwarder, the carrier or the person or institution otherwise designated to carry out the shipment, if the customer has commissioned the freight forwarder, the carrier or the person or institution otherwise designated to carry out the shipment and the seller has not previously named this person or institution to the customer.

    5.4 The seller reserves the right to withdraw from the contract in the event of incorrect or improper self-delivery. The seller will make all reasonable efforts to procure the goods. In the event of unavailability or only partial availability of the goods, the customer will be informed immediately and the consideration will be refunded immediately.

    5.5 If the seller offers the goods for collection, the customer can collect the ordered goods from the address specified by the seller during the business hours specified by the seller. In this case, no shipping costs will be charged.

    6) Retention of title

    If the seller makes advance payments, he retains title to the delivered goods until the purchase price owed has been paid in full.

    7) Liability for defects (warranty)

    7.1 Unless otherwise stated in the following provisions, the provisions of statutory liability for defects apply. The following applies to contracts for the delivery of goods:

    7.2 If the customer acts as an entrepreneur,

    • the seller has the choice of the type of subsequent performance;
    • For new goods, the limitation period for defects is one year from delivery of the goods;
    • In the case of used goods, rights and claims due to defects are excluded;
    • The limitation period does not begin again if a replacement delivery is made within the scope of liability for defects.

    7.3 The limitations of liability and shortening of time limits set out above do not apply

    • for claims for damages and reimbursement of expenses by the customer,
    • in the event that the seller has fraudulently concealed the defect,
    • for goods which have been used in accordance with their normal use for a building and have caused its defectiveness,
    • for any existing obligation of the seller to provide updates for digital products, in contracts for the delivery of goods with digital elements.

    7.4 In addition, for entrepreneurs, the statutory limitation periods for any existing statutory recourse claim remain unaffected.

    7.5 If the customer acts as a merchant within the meaning of Section 1 of the German Commercial Code (HGB), he is subject to the commercial duty of inspection and notification of defects in accordance with Section 377 of the German Commercial Code (HGB). If the customer fails to comply with the notification obligations set out therein, the goods are deemed to have been approved.

    7.6 If the customer is a consumer, he is requested to complain to the deliverer about goods that have obvious transport damage and to inform the seller of this. If the customer does not do this, this will have no effect on his legal or contractual claims for defects.

    8) Applicable law

    The law of the Federal Republic of Germany shall apply to all legal relationships between the parties, excluding the laws governing the international sale of movable goods. For consumers, this choice of law shall only apply to the extent that the protection granted is not withdrawn by mandatory provisions of the law of the state in which the consumer has his or her habitual residence.

    9) Alternative dispute resolution

    9.1 The EU Commission provides a platform for online dispute resolution on the Internet at the following link: https://ec.europa.eu/consumers/odr

    This platform serves as a contact point for the out-of-court settlement of disputes arising from online sales or service contracts involving a consumer.

    9.2 The Seller is neither obliged nor willing to participate in a dispute settlement procedure before a consumer arbitration board.

    If a user clicks on an ad we have placed on Facebook, the URL of our linked page is extended by a parameter using "Facebook Pixel". This URL parameter is then entered into the user's browser after forwarding via a cookie that our linked page itself sets.

    This enables Facebook to determine the visitors to our online offering as a target group for the display of advertisements (so-called "Facebook Ads"). Accordingly, we use the service to only display the Facebook ads we place to those Facebook users who have also shown an interest in our online offering or who have certain characteristics (e.g. interests in certain topics or products determined based on the websites visited) that we transmit to Facebook (so-called "custom audiences").

    On the other hand, “Facebook Pixel” can be used to track whether users were redirected to our website after clicking on a Facebook ad and which actions they perform there (so-called “conversion tracking”).

    The data collected is anonymous to us and does not allow us to draw any conclusions about the identity of the user. However, the data is stored and processed by Facebook so that a connection to the respective user profile is possible and Facebook can use the data for its own advertising purposes.

    All processing described above, in particular the setting of cookies for reading information on the device used, will only be carried out if you have given us your express consent in accordance with Art. 6 Paragraph 1 Letter a of GDPR. You can revoke your consent at any time with effect for the future by deactivating this service in the "Cookie Consent Tool" provided on the website.

    We have concluded a data processing agreement with the provider, which ensures the protection of the data of our website visitors and prohibits unauthorized disclosure to third parties.

    The information generated by Facebook is usually transferred to a Facebook server and stored there; in this context, it may also be transferred to Meta Platforms Inc. servers in the USA.

    For data transfers to the USA, the provider has joined the EU-US Data Privacy Framework, which ensures compliance with the European data protection level on the basis of an adequacy decision of the European Commission.

    9) Tools and Others

    Cookie Consent Tool

    This website uses a so-called "cookie consent tool" to obtain effective user consent for cookies and cookie-based applications that require consent. The "cookie consent tool" is displayed to users when they visit the page in the form of an interactive user interface on which consent for certain cookies and/or cookie-based applications can be given by ticking boxes. By using the tool, all cookies/services that require consent are only loaded if the respective user gives their consent by ticking the box. This ensures that such cookies are only placed on the user's respective device if consent has been given.

    The tool uses technically necessary cookies to save your cookie preferences. Personal user data is generally not processed.

    If, in individual cases, personal data (such as the IP address) is processed for the purpose of storing, assigning or logging cookie settings, this is done in accordance with Art. 6 (1) (f) GDPR on the basis of our legitimate interest in legally compliant, user-specific and user-friendly consent management for cookies and thus in a legally compliant design of our website.

    A further legal basis for the processing is Art. 6 (1) (c) GDPR. As the responsible party, we are subject to the legal obligation to make the use of technically unnecessary cookies dependent on the respective user consent.

    Where necessary, we have concluded a data processing agreement with the provider, which ensures the protection of the data of our website visitors and prohibits unauthorized disclosure to third parties.

    10) Rights of the data subject

    11) Duration of storage of personal data

    The duration for which personal data is stored is determined based on the respective legal basis, the purpose of processing and – if applicable – also on the respective statutory retention period (e.g. retention periods under commercial and tax law).

    When processing personal data on the basis of an express consent in accordance with Art. 6 (1) (a) GDPR, the data concerned will be stored until you revoke your consent.

    If there are statutory retention periods for data that are processed within the framework of legal or quasi-legal obligations on the basis of Art. 6 (1) (b) GDPR, these data will be routinely deleted after expiry of the retention periods, provided that they are no longer required to fulfill or initiate a contract and/or we no longer have a legitimate interest in continuing to store them.

    When processing personal data on the basis of Art. 6 (1) (f) GDPR, these data will be stored until you exercise your right of objection in accordance with Art. 21 (1) GDPR, unless we can demonstrate compelling legitimate grounds for the processing which outweigh your interests, rights and freedoms, or the processing serves to assert, exercise or defend legal claims.

    When processing personal data for the purpose of direct marketing on the basis of Art. 6 (1) (f) GDPR, these data will be stored until you exercise your right of objection in accordance with Art. 21 (2) GDPR.

    Unless otherwise stated in the other information in this declaration on specific processing situations, stored personal data will be deleted when they are no longer necessary for the purposes for which they were collected or otherwise processed.

    A. Cancellation policy

    Introduction

    Consumers have a right of withdrawal in accordance with the following provisions, whereby a consumer is any natural person who concludes a legal transaction for purposes that can predominantly neither be attributed to their commercial nor their independent professional activity:

    Right of withdrawal

    You have the right to withdraw from this contract within fourteen days without giving any reason.

    The cancellation period shall be fourteen days from the day on which you or a third party other than the carrier designated by you takes possession of the last good.

    To exercise your right of withdrawal, you must inform us (Andre Bräuer, Langacker 4, 23730 Neustadt in Holstein, Germany, Tel.: 017631022237, Email: andre.braeuer@icloud.com) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or email). You can use the attached model withdrawal form for this purpose, but this is not mandatory.

    To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right of cancellation before the cancellation period has expired.

    Consequences of revocation

    If you cancel this contract, we will refund all payments that we have received from you, including delivery costs (with the exception of additional costs resulting from your choosing a different type of delivery than the cheapest standard delivery offered by us), promptly and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged any fees for this refund. We may refuse to refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.

    You must return or hand over the goods to us promptly and in any event no later than fourteen days from the date on which you notify us that you have cancelled this contract. This deadline is met if you send the goods before the expiry of the fourteen-day period.

    You will bear the direct cost of returning the goods.

    You only have to pay for any loss of value of the goods if this loss of value is due to handling of the goods which is not necessary to check their quality, properties and functioning.

    General information

    1) Please avoid damaging or contaminating the goods. Please send the goods back to us in their original packaging with all accessories and packaging components. If necessary, use protective outer packaging. If you no longer have the original packaging, please use suitable packaging to ensure adequate protection against transport damage.
    2) Please do not send the goods back to us freight collect.
    3) Please note that the above points 1-2 are not a prerequisite for the effective exercise of the right of withdrawal.
